MUMBAI: The 37-year-old US citizen held for allegedly smoking onboard AI-130 London-Mumbai flight, trying to open the emergency exit midair and kicking fellow flyers last week refused to pay Rs 25,000 bail amount on Monday, saying he would only pay Rs 250 since an online search had showed him this was the fine to be paid under the Indian Penal Code Section 336. The accused, Ratnakar Dwivedi, who claimed to be an entrepreneur, was sent to Arthur Road jail on Monday evening, despite the Andheri metropolitan magistrate S A R Sayed granting him bail on the condition that he would not leave the country without prior permission of the court.
Dwivedi was booked under Section 336 for a rash or negligent act that can endanger human life or safety of others and the Aircraft Rules 1937. He told Sahar police and his lawyer that he was ready to spend time in jail instead of paying the bail amount.
Dwivedi, who was allowed to leave on Saturday with a notice by Sahar police who seized his US passport, was arrested after the chargesheet in the case was filed on Monday.
“The chargesheet is attached with the statements, a blue cigarette lighter and an e-cigarette, which are part of the evidence in the case. The chargesheet said the accused put the lives of several flyers onboard in danger by his act of smoking, creating a ruckus and trying to open the emergency exit mid-air…,” said an officer from Sahar police station.
